General conditions of sale

1. Object

These General Terms and Conditions of Sale (hereinafter "GTC") govern all contractual relations between Le Clos de la Platière, an establishment located at 5, Rue de la Patière – 39100 JOUHE - FRANCE, hereinafter referred to as "the Host", and any natural or legal person making a reservation for accommodation, hereinafter referred to as "the Customer".

Any booking implies the Customer's full and unconditional acceptance of these terms and conditions, who acknowledges having read them before confirming their reservation.

2. Booking and conclusion of the contract

The booking becomes confirmed upon receipt of a 40% deposit of the total stay amount, unless otherwise stated at the time of booking.

The booking can be made:

  • via the Host's official website,
  • by email,
  • or by phone.

Once the deposit has been received, a written confirmation (confirmation email) is sent to the Customer, which serves as validation of the rental agreement.

The Host reserves the right to refuse any booking if the deposit payment is not made, or if the information provided by the Customer is found to be incomplete or incorrect.

3. Price and tourist tax

The prices shown on the Clos de la Platière website are quoted in euros, including all taxes (VAT)..

They include the rental of the accommodation for the indicated duration, utilities (water, electricity, heating, bed linen, internet access, etc.), unless otherwise specified.

The tourist tax set by the local authority is collected in addition and specified at the time of booking. It is fully remitted to the local community or the relevant town hall.

4. Payment of the balance

The balance of the stay must be paid no later than 3 days before the arrival date.
In the case of a last-minute booking (less than 3 days before arrival), full payment for the stay is required at the time of booking.

If payment is not made within the specified period, the Host reserves the right to cancel the reservation without notice or compensation, and to make the accommodation available for rent again.

5. Cancellation conditions

Cancellation by the Customer

Any cancellation must be notified in writing, either by email or by mail.

The amounts paid are retained according to the following scale:

  • Cancellation more than 3 days before the arrival date: 20% of the total amount of the stay remains with the Host.
  • Cancellation less than 3 days before the arrival date or no-show: 50% of the total amount of the stay remains with the Host.

In the event of a shortened stay, the full amount of the stay remains due. No refund will be given.

Cancellation by the Host

In the event of an exceptional inability to honor the reservation (force majeure, accident, serious breakdown, health reasons, etc.), the Host agrees to:

  • inform the Client as soon as possible
  • offer, as far as possible, equivalent accommodation,
  • or proceed with a full refund of the amounts paid.

No other compensation may be claimed by the Customer.

6. Arrival and departure times

Arrivals are from 6:00 PM..
Departures must take place before 10:00 AM..

In the case of the "Late Departure"option, the Guest may stay in the accommodation until 1:00 PM, subject to availability and prior agreement with the Host.

In the case of the "Early Arrival"option, the Guest may stay in the accommodation from 2:00 PM, subject to availability and prior agreement with the Host.

Any arrival or departure outside the agreed hours must be the subject of a written agreement between the parties.

7. Capacity and use of premises

The rental agreement is established for a specific number of people. If this number is exceeded, the Host reserves the right to:

  • refuse additional persons,
  • or to immediately terminate the contract, without refund of any amounts paid.

The Customer agrees to use the rented premises peacefully and to comply with the house rules, safety instructions, and neighborhood considerations.

Parties or noisy events are not allowed without prior agreement.

8. Security deposit

A security deposit of €300 may be requested upon arrival.
It will be refunded at the end of the stay, after an inspection, minus any deductions for missing items or damages observed.

In the event of an early departure preventing an immediate inspection, the security deposit will be refunded within a maximum of 7 days after departure, by bank transfer or check.

9. Liability and Insurance

The Customer is responsible for all damage caused by themselves, by accompanying persons, or by their pets (if allowed).

The Host declines all responsibility in the event of:

  • theft, loss, or damage to personal belongings,
  • accidents occurring in or around the accommodation due to the Client's negligence,
  • interruption of public services (water, electricity, internet) beyond their control.

The Customer is encouraged to take out holiday insurance covering any damage they may cause during their stay. Proof of insurance may be requested at any time.

For a group booking (multiple accommodations), the Customer must be able to provide a civil liability insurance certificate covering any damage that may occur during the stay.

10. Animals

Pets may be allowed only upon prior request and with the written consent of the Host..
Their presence may be subject to a flat fee specified at the time of booking.

The Customer must inform the Host before arrival of the presence of any animal, specifying the number, type, and size.
The Host reserves the right to refuse any animal that does not meet the accommodation conditions or whose behavior could disrupt the stay.

Admitted animals must:

  • be kept under constant supervision,,
  • be be kept on a leash in shared common and outdoor areas,
  • not be left alone in the accommodation in the absence of their owner,
  • be clean, vaccinated, and treated against parasites..

The Customer agrees to respect the peace of other guests and to maintain the cleanliness of the premises (picking up waste, protecting furniture, etc.).

The Host may retain all or part of the security deposit in the event of:

  • damage or soiling caused by the animal,
  • noise disturbance,
  • non-respect des présentes conditions.

Customer Responsibility

The Customer remains fully responsible for any material or bodily damage caused by their animal:

  • to the accommodation and its facilities,
  • to other clients, visitors, or staff of the establishment,
  • or to other animals present on the premises.

In the event of damage or biting, the Customer agrees to all costs for repairs, cleaning, veterinary, or medical expenses that may result.

The Host declines all responsibility in the event of:

  • incident, injury, or loss of an animal,
  • or damage caused by another animal belonging to a Customer.

The Host reserves the right to terminate the stay, without refund, in the event of dangerous or disrespectful behavior towards an animal or its owner.

11. Additional services and optional benefits

The Host may offer the Customer, in addition to the accommodation rental, additional services such as:

  • the booking of dinners, breakfasts, or packed meals,
  • the sale of drinks,
  • the rental of bicycles,
  • the provision of specific equipment (baby bed, spa, bicycles, etc.),
  • or any other additional service offered on site.

These services are charged in addition to the stay, according to the rates in effect at the time of booking or consumption.
Their cost will be included on the final invoice for the stay..

Booking and billing terms

Additional services may be:

  • ooked in advance when making the reservation (via the website), or
  • added during the stay, subject to availability (by requesting directly from the accommodation provider or via the website).

They are payable at the time of the Guest's departure unless another payment method has been agreed with the Accommodation Provider.

In the event of failure to pay at departure, the Accommodation Provider reserves the right to:

  • charge the amount due to the credit card used for the reservation, in accordance with the authorization given at the time of booking, or
  • issue an additional invoice payable immediately.

Cancellation or non-use of an additional service

Any service ordered but not used or cancelled less than 12 hours before its scheduled time (for example, a reserved dinner that is not attended) will be fully charged at the time of departure, except in cases of duly justified force majeure.

12. Cases of Force Majeure

None of the parties shall be held responsible for the partial or total non-performance of their obligations in the event of force majeure: natural disaster, fire, strike, war, epidemic, administrative prohibition, etc.

The force majeure event suspends the parties' obligations for its duration. If the event lasts more than 30 days, the contract may be terminated automatically, without compensation or penalty.

13. Personal Data

The information collected during the booking is necessary for order management and communication with the Customer.

It may be used for commercial prospecting purposes only by Le Clos de la Platière, unless the Client explicitly objects.

In accordance with the General Data Protection Regulation (GDPR) and the French Data Protection Act, the Customer has the right to access, rectify, delete, and object to the processing of their personal data.

13. Complaints and Mediation

Any complaint relating to the stay must be sent to the Host in writing, within 7 days after the end of the stay.

In the event of an unresolved disagreement, the Customer may contact the Tourism and Travel Mediator (MTV) :

Using mediation is free of charge for the Customer.

14. Applicable law and competent court

This contract is subject to French law.
In case of a dispute, and if an amicable resolution cannot be reached, the competent court will be that of the jurisdiction of the place of accommodation, namely the Court of Dole (39).

15. Acceptance of the terms

The booking confirmation by the Client constitutes full and complete acceptance of these Terms and Conditions of Sale.

No special condition can, except with the written agreement of the Host, take precedence over these T&Cs.
